14歲男孩強奸殺害女同學案，一審宣判！

云南曲靖“14歲男生殺害同學”一案引發關注，相關庭審細節沖上熱搜。

4月28日下午，云南省曲靖市中級人民法院一審公開宣判被告人蔣某某故意殺人、強奸一案，以故意殺人罪、強奸罪判處蔣某某無期徒刑，剝奪政治權利終身。

A court in Yunnan province sentenced a teenager to life imprisonment on Tuesday for the attempted rape and subsequent murder of his classmate.

The Intermediate People's Court in Qujing found the boy, identified by his surname Jiang, guilty of rape and intentional homicide.

經審理查明，被告人蔣某某（時年14歲）與被害人方某某（歿年15歲）系同學。2025年7月6日晚至7日凌晨，蔣某某采用暴力手段企圖對方某某實施奸淫，后恐罪行敗露用雙手掐住方某某頸部致其死亡。

It said that on the night of July 6 into the early hours of July 7, 2025, Jiang attempted to rape a girl using violence and, fearing exposure, strangled her to death.

Jiang was 14 at the time of the crime, and the victim was 15, the court said.

曲靖市中級人民法院認為，被告人蔣某某的行為分別構成強奸罪、故意殺人罪，依法應數罪并罰。蔣某某犯罪情節特別惡劣，后果嚴重，應依法嚴懲。蔣某某犯罪時不滿十八周歲，依法不適用死刑。根據其犯罪事實、性質、情節和對社會的危害程度，遂作出上述判決。

The court described the circumstances as "extremely serious", warranting severe punishment. Because Jiang was under 18, the death penalty was not considered under Chinese law.

The court imposed life imprisonment, the maximum penalty for juvenile offenders, based on the nature and severity of his actions.

被害人家屬：已提交抗訴材料

判決結果公布后，被害人父親方先生在接受媒體采訪時表示，不接受且已當庭向檢方提交了抗訴材料。

據極目新聞，宣判后，被害人父母當即向曲靖市人民檢察院提起抗訴申請，檢察院已受理。

The victim's family rejected the ruling and submitted protest materials to prosecutors, seeking a harsher sentence. Prosecutors in Qujing have accepted the application.

方先生走出法庭后告訴記者，從進入法庭到宣判，他看到被告蔣某某幾乎沒什么表情。

The victim's father said the defendant showed almost no emotion in court.

此前在庭審結束后，被害方代理律師周兆成回憶，被告在庭審上依然對關鍵作案細節刻意回避、拒不如實陳述；在法官訊問時，當庭供述與此前供述也存在前后矛盾，認罪態度極差。“直到最后陳述，被告人才勉強向被害人父母表示歉意，甚至提出出獄后希望可以贍養被害人父母，被被害人父母斷然拒絕。”

The family's lawyer, Zhou Zhaocheng, said the defendant avoided key details, gave inconsistent statements, and showed little remorse, offering only a reluctant apology at the end of the trial. Jiang also said he hoped to support the victim's parents after his eventual release, a proposal the family firmly rejected.

律師：無期已是頂格處罰

本案受害方的代理律師周兆成律師表示，判處無期已是現行法律框架下對未成年罪犯的頂格處罰和最重懲戒。

這一判決雖守住了司法的底線，卻依舊難以撫平被害人父母撕心裂肺的喪女之痛。

Zhou said life imprisonment is the maximum punishment available for juvenile offenders under China's current legal framework. He added that while the ruling upheld justice, it could not ease the profound grief of the parents over the loss of their daughter.
